Summary

Many Australian families are reluctant to document arrangements for the care of elderly parents. A number of cases have been issued whereby a constructive trust is pleaded in order to hold a party to an undocumented promise or  provide other remedial relief. The seminar outlines how constructive trusts might be pleaded to achieve the best outcome, and how such family arrangements might better be documented to prevent litigation.
